Privacy Policy for Guests on Our All Inclusive Plan

Overall Provisions

  • Once the conditions under which the HOTEL will provide the services offered to the GUEST have been accepted, the latter will be subject to the provisions of this regulation, considering it as a contract and will be obliged to comply with all its points.

  • The following regulations will be valid for the duration of the stay or provision of services provided by the HOTEL to the GUEST and until the debt or expense arising from the provision of services to the GUEST is settled.

  • The HOTEL does not reserve the right to provide its services to any person for reasons of race, religion, sexual orientation, physical or socioeconomic condition, or for any other reason.

  • The HOTEL reserves the right to refuse admission to persons who threaten the safety of guests and/or employees, and who are under the influence of alcohol or any unauthorized drug.

  • Any GUEST who displays an aggressive, threatening attitude or who is disrespectful in any way, whether towards the HOTEL staff or its guests, will be entitled to be asked to leave by the HOTEL and may be reported to the competent authorities.

  • The HOTEL is not obliged to apply any type of discount. Therefore, any promotions or discounts offered to the guest will be at the discretion of the HOTEL.

  • THE HOTEL reserves the rights to schedule internal activities, consumption centers, recreational areas and other services offered, which may be changed or modified according to the operation and needs of the HOTEL, without prior notice.

  • Every GUEST who has a vehicle and circulates within the HOTEL's property must respect at all times the speed limits and safety regulations established by the HOTEL. The hotel's parking lot is for the exclusive use of guests and clients. The HOTEL is not responsible for damages caused to the vehicle resulting from unforeseen events, force majeure or accidents caused by another vehicle, theft of parts or items left inside the vehicle.

Guest Check-in, Identification, and Check-out

  • All clients will be asked for an open voucher or deposit of at least $1,000 (One thousand pesos) per room, which will be refunded at the end of their stay once all room debts have been settled.

  • The HOTEL displays its category, current lodging rates and these regulations in the reception area, in accordance with the provisions of NOM_010_-TUR_2001. The lodging amount must be paid in full by the GUEST in the currency of the United Mexican States, in cash or with a valid credit card; checks are not accepted as a form of payment. The HOTEL reserves the right to demand payment at the end of the lodging or periodically, at the discretion and convenience of the HOTEL. In the event that the GUEST does not pay the HOTEL the full amount of the lodging, the HOTEL Management will automatically terminate the lodging contract, immediately demanding the eviction of the room and retaining the luggage as collateral. In the event that the HOTEL is not paid within thirty calendar days, the HOTEL will have the power to make an inventory of the luggage with the presence of two witnesses to offer it for sale. If the HOTEL determines that the value of said luggage is less than the amount owed, proceedings will be taken before the competent authorities.

  • Every GUEST staying at the HOTEL must register on the guest registration card indicating their name, address and defining the date of check-in and check-out of the HOTEL, as well as the name and age of the persons accompanying them. For security reasons, at the time of registration of the GUEST, a valid official identification with a photograph will be required for all registered guests and their visitors. The identification with a photograph must also match the name that appears on the reservation. The HOTEL reserves the right to deny entry to guests who do not have a valid identification with a photograph. The data and personal information provided by the GUEST to the HOTEL will be collected, processed and stored in accordance with the terms and conditions of the Privacy Notice that was made known upon entering the HOTEL at the reception or on the registration card.

  • The cost of lodging is per fraction or full day, which will be calculated from 3:01 p.m. on one day to 11:00 a.m. on the following day, and then taking into account one hour's grace period to vacate the room completely. If the GUEST does not vacate the room on time, an additional day of lodging will be charged directly to their account.

  • Requests not made at the time of booking are subject to availability.

  • If you require a later check-out or an earlier arrival than the scheduled time, an Early check-in or Late check-out charge will be generated, subject to availability.

  • Food and drinks that have not been purchased at our consumption centers are not permitted. Avoid having them taken away when detected.

Dining areas

  • Breakfast served in the restaurant area from 8:00 – 11:30 hrs.

  • Snack Bar available in the restaurant area from 1:00 p.m. to 5:00 p.m.

  • Dinner hours: 7:00 p.m. – 10:00 p.m.

    • Dress code for dinner time: casual – beach, (no bathing suits, no bathing suits)

  • Bar open from 12:00 – 22:30 hrs.

    • The HOTEL will refuse service and sale of alcoholic beverages to any GUEST who is visibly intoxicated by alcohol or any type of intoxicating substance, thereby ensuring the safety of the GUEST and other GUESTS. The HOTEL may reserve the right to request that any GUEST who is disturbing public order due to the influence of alcohol or any illegal intoxicating substance leave the consumption center or public area and go to his or her room. In the event of refusal, the GUEST may be referred to the competent authorities.

  • Room Service for all-inclusive plan from 12:00 – 21:00 hrs. with a cost of 20% of the total check per event.

  • Pool open from 8:00 – 19:00 hrs.

 

  • Dinner roll from Monday to Sunday

    • Monday: Land and Sea

    • Tuesday: Oaxacan

    • Wednesday: Tour of Mexico

    • Thursday: International

    • Friday: Italian

    • Saturday: Oaxacan

    • Sunday: Chef's Night (International)

 

Food is subject to occupancy to be served buffet style, or the client may have the option to choose from the menus stipulated by the hotel, with prior reservation, thus guaranteeing the all-inclusive plan within the previously mentioned times, but not obliged to serve a buffet as part of the service.

 

  • It is not permitted to bring speakers, loudspeakers or audio devices into the restaurant and pool areas.

Protected natural areas

  • The Hotel protects the wildlife located on its premises in accordance with Mexican environmental regulations. Guests and visitors must respect the wildlife at all times. Any violations will result in the General Manager requesting their departure. The Hotel will seek damages and file a report with the relevant environmental authorities for any intentional damage caused by the guest or visitor.

Tobacco consumption

  • Pursuant to the General Law for Tobacco Control, its regulations, and applicable laws, smoking is strictly prohibited in all areas and guest rooms of the HOTEL except in designated smoking areas. Any guest found in violation of this policy will be subject to fines imposed by the competent authorities. The HOTEL reserves the right to charge additional fees for the cleaning and deodorizing of guest rooms, including bedding and linens, as a result of smoking.

  • The consumption of illicit substances is strictly prohibited on the premises. Guests found in possession of or using such substances will be reported to the appropriate authorities.

Drone usage

  • Drones are remotely piloted aircraft. Their misuse can pose a risk to physical safety, data protection, and the privacy of our guests, visitors, and property. Therefore, the Hotel prohibits the recreational use of any remotely piloted aircraft on its premises. In case of non-compliance, the Hotel Management may request that the use be stopped and, if applicable, that the guest or visitor operating the aircraft be asked to leave the Hotel for security reasons and, primarily, to protect the privacy of our guests. Regulations: Mandatory Circular of April 8, 2015, issued by the Secretariat of Communications and Transportation and the General Directorate of Civil Aviation, which establishes the requirements for operating a remotely piloted aircraft system.

Cancellation of the accommodation agreement

  • The following are grounds for termination of the ACCOMMODATION CONTRACT by the GUEST: a. Failure by the HOTEL to comply with the terms and conditions of the ACCOMMODATION CONTRACT. b. Violation of the physical and moral integrity of the GUEST by employees of the HOTEL. In such cases, the HOTEL will only reimburse the GUEST for the amount of the advance payment made, less any charges already incurred per room and other consumption, which must always be paid to the HOTEL.

  • The following are grounds for termination of the ACCOMMODATION CONTRACT without liability for the Hotel: a. Failure by the GUEST to comply with the terms and conditions of the ACCOMMODATION CONTRACT and these regulations. Failure to pay in a timely manner the total amount generated by the provision of services made by the HOTEL to the GUEST. b. In the event that the GUEST is intoxicated or under the influence of any type of illegal intoxicating substance and disturbs the rest and tranquility of the other GUESTS or incurs in breaches of morality, good customs or by assaulting any employee of the HOTEL. c. Violating the physical and moral integrity of other GUESTS and employees and their belongings. d. Partially or totally damaging the facilities, equipment and furniture that the HOTEL makes available to the GUEST or his guests. In the event of incurring any damage. e. The GUEST agrees to pay the HOTEL the cost of repairing or replacing any object, furniture or material property of the HOTEL that has been totally or partially damaged, whether through carelessness or intentionally. The GUEST must report any damage to his/her room to reception immediately after taking possession of it (broken glass, scratched or burnt furniture, etc.). Failure to do so may result in the HOTEL being held liable for any damage. f. Allowing guests or pets other than the HOTEL to use the facilities and enjoy the privileges enjoyed by the GUEST, without prior authorization registered at the hotel reception. Removing any equipment, furniture or protected species that are the property of or are found within the facilities of the HOTEL. g. Carrying any type of weapon or illegal substance that endangers guests and/or employees of the HOTEL. Any GUEST who is caught carrying a weapon, even with a permit to carry weapons, will be asked by the Management to keep it in the safe in his/her room for the safety of the guests and HOTEL staff. h. The GUEST will be responsible for compensating for any type of physical or moral damage intentionally caused to third parties within the HOTEL facilities and will be referred to the competent authorities.

  • In the event that the HOTEL terminates the ACCOMMODATION CONTRACT with the GUEST for any of the aforementioned reasons, the HOTEL shall be entitled to demand and carry out the eviction of the room assigned to the GUEST, and may use public force as well as retain the GUEST's luggage as a guarantee for the damages and losses caused by its actions to the HOTEL, without prejudice to the HOTEL making effective the promissory note called VOUCHER to guarantee the payment obligations under its charge.

Complaints or suggestions

  • Any guest complaints, suggestions, or compliments regarding the quality of service provided are encouraged to be noted on the corresponding form, which can be requested at the hotel reception.

Privacy Policy:

  • Coral Blue Huatulco with address at Colonia Mirador Chahué, Block 8, Lot 3, Bahías, 70988 Bahias de Huatulco, Oax, is responsible for obtaining and using your personal data, the use that is given to them as well as their protection.

  • In accordance with the provisions of articles 8, 15, 16 and 36 of the FEDERAL LAW ON THE PROTECTION OF PERSONAL DATA HELD BY PRIVATE PARTIES (LFPDPPP).

  • The objective

  • It is to give appropriate, controlled and legal use of the personal data that is handled for the processes of the Administrative System at the Coral Blue Huatulco Hotel.

  • Your information is required for the hotel's internal processes. The means to obtain it include registration forms, telephone reservations, quotes, agreements, satisfaction surveys, your comments, complaints and/or suggestions.

  • The personal data requested are:

  • Full name (First name, father's and mother's surname).

  • Guest Signature

  • Home phone and Cell phone.

  • Credit or debit card information

  • E-mail.

  • Origin.

  • RFC

  • This information will be used for the following purposes:

  • Security during the guest's stay.

  • Making reservations

  • Tax receipts.

  • Sending promotional information from the company

  • To generate a customer database;

  • Improved control and implementation of subsequent service processes.

Security and protection of your personal data

  • Coral Blue Huatulco Hotel intends to use the personal and/or sensitive data collected through this Privacy Notice for the proper operation and purposes of the Hotel and to comply with government requests. This information may be used for administrative, marketing, sales, statistical, and other purposes that may benefit the Data Subject.

  • Coral Blue Huatulco Hotel is responsible for safeguarding personal data and will take all necessary measures to prevent the loss or theft of information stored in physical and digital files.
    We are committed to not transferring your personal data to third parties without your consent, except as provided for in Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, and to carry out such transfer under the terms established by that law.   

Exceptions to Article 37:

  • When the transfer is provided for in a Law or Treaty to which Mexico is a party;

  • When the transfer is necessary for medical prevention or diagnosis, the provision of health care, medical treatment, or the management of health services;

  • When the transfer is made to controlling companies, subsidiaries or affiliates under the common control of the data controller, or to a parent company or any other company of the same group of the data controller that operates under the same internal processes and policies;

  • When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the data subject, by the data controller and a third party;

  • When the transfer is necessary or legally required for the safeguarding of a public interest, or for the prosecution or administration of justice;

  • When the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding; and When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the data controller and the data subject. For the exceptions provided for in Article 37 of the Federal Law on the Protection of Personal Data, if you do not express your opposition to the transfer of your personal data, it will be understood that you have given your consent for it.   

Explicit indication of sensitive personal data

  • In addition to the personal data mentioned above, Coral Blue Huatulco Hotel will use the following sensitive personal data for the purposes outlined in this privacy notice: present and future health status, religious, philosophical and moral beliefs, and union membership. Please be informed that the processing of this sensitive personal data is intended to allow Coral Blue Huatulco Hotel to fulfill its obligations arising from our legal relationship with the Data Subject. We are committed to processing this data under security measures that guarantee its confidentiality.

Means to revoke consent for the processing of personal data

  • You may revoke your consent for the processing of your personal data by submitting a request to the Data Protection Officer in writing, by email, or by phone. If you subsequently request confirmation of such revocation, the Data Controller will respond to you expressly.

Means to exercise ARCO rights

  • You have the right to: (i) access your personal data in our possession and know the details of the processing thereof, (ii) rectify them if they are inaccurate or incomplete, (iii) cancel them when you consider that they are not required for any of the purposes indicated in this privacy notice, they are being used for purposes not consented to or the contractual or service relationship has ended, or (iv) oppose the processing of them for specific purposes, as required by law, (jointly, the “ARCO Rights”).

  • To exercise your ARCO Rights, you must submit a request (the “ARCO Request”) to the Controller, to the Privacy Officer, to the Contact Address, accompanied by the following information and documentation:

  • Your name, address and email address so that we can communicate the response to the ARCO Request;

  • A copy of the documents that prove your identity (copy of IFE, passport or any other official identification) or, where applicable, the documents that prove your legal representation, the original of which must be presented in order to receive a response from the Controller;

  • A clear and precise description of the personal data in respect of which you seek to exercise any of the ARCO Rights;

  • Any document or information that facilitates the location of your personal data, and;

  • If you request a correction of your personal data, you must also indicate the changes to be made and provide the documentation to support your request.

  • The Privacy Officer will respond to your ARCO Request and the reasons for his/her decision by email.

Cookies and Web Beacons

  • Please note that when accessing websites, you may encounter "cookies," which are text files that are automatically downloaded and stored on your computer's hard drive when you visit a specific website. These cookies allow the website server to record some of your data.

  • Additionally, websites may use "web beacons," tiny images embedded in web pages or emails. These beacons allow us to track visitor behavior, collecting data such as the visitor's IP address, the length of time spent on a page, and the type of browser used.

  • Accordingly, please be advised that Coral Blue Huatulco Hotel may use "cookies" and "web beacons" to enhance website performance.

A.R.C.O. rights

  • Rights to access, rectification, cancellation and opposition of personal data.

  • You have the right to access, rectify, cancel, and oppose the processing of your personal data, as well as to revoke the consent you have given us for such processing, in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties.
